These Terms and Conditions govern your use of thedifferentsociety.com.au and any purchases made through it. By using the site or placing an order, you agree to these terms. They apply to all users in Australia and internationally.

The Different Society is an Australian design-led brand creating inclusive products rooted in lived experience. We're based in Australia and operate under The Different Society Pty Ltd. (ABN 71 687 897 132).
When we say 'TDS', 'we', 'us', or 'our' in these terms, that's who we mean.
2. Using Our Website
By accessing and using our site, you agree to use it lawfully and in good faith.
You may not:
Use the site for any unlawful or fraudulent purpose
Attempt to gain unauthorised access to any part of the site or its systems
Copy, reproduce, or redistribute our content without written permission
Use the site in a way that could damage or disrupt it
We reserve the right to restrict or remove access for anyone in breach of these terms.
3. Orders and Payment
When you place an order, you're making an offer to purchase. We accept that offer when we confirm your order by email.
If for any reason we can't fulfil your order, we'll let you know and issue a full refund.
All prices are listed in Australian dollars and include GST where applicable. We reserve the right to update pricing at any time, but the price at the time of your order is the price you pay.
We accept payment through the methods listed at checkout. Payments are processed securely by third-party providers. We do not store your card details.
If something goes wrong with your order, we want to know. Reach out and we'll fix it.
4. Shipping
We ship within Australia. Delivery times and costs are calculated at checkout based on your location and chosen shipping method.
Once your order has been dispatched, a tracking number will be sent to your email address. We partner with trusted carriers, but transit times are estimates and not guaranteed.
Risk passes to you once the order is dispatched. If your order is lost or damaged in transit, please contact us and we'll work with you to resolve it.

5. Returns and Exchanges
We want you to love what you receive. If something isn't right, we offer a 14-day return window from the date of delivery, subject to the following:
Items must be unworn, unwashed, and in their original condition with tags attached
Sale items and limited-edition pieces are final sale unless faulty
We do not cover the cost of return shipping unless the item is faulty or we made an error
To start a return or exchange, email us at hello@thedifferentsociety.com with your order number and the reason for the return. We'll guide you through the process.
We offer exchange or store credit in the form of a digital giftcard.
6. Faulty or Incorrect Items
If your item arrives damaged or you believe something may be faulty, please contact us at hello@thedifferentsociety.com with your order number, a brief description of the issue and clear photos.
We’ll review the information provided and may ask for the item to be returned for physical assessment before confirming the appropriate next step.
If the item is found to be faulty or damaged, we’ll work with you to provide a remedy in line with Australian Consumer Law. This may include a repair, replacement or refund, depending on the nature of the issue.
Please note that damage caused by normal wear and tear, misuse, incorrect care or change of mind is not considered a fault.
7. Limited Edition and Collaboration Pieces
Some products, including our ACID.FLWRS collaboration pieces, are limited edition and will not be reproduced. Once they're sold out, they're gone. We don't offer holds or reservations on limited stock.
Collaboration products are subject to the same return and exchange conditions as all other items.
8. Intellectual Property
Everything on this site, including copy, images, brand assets, product designs, and the Sensory Profile framework, is owned by The Different Society or used with permission. You may not reproduce, distribute, or use any of it without our written consent.
The Different Society name, the asterisk mark, and the D* logo are brand assets of The Different Society. Do not use them without permission.
9. Discount Codes and Promotions
Discount codes are single-use unless otherwise stated. They cannot be applied retrospectively to previous orders, combined with other offers, or exchanged for cash.
We reserve the right to cancel or modify promotions at any time.
10. Limitation of Liability
To the extent permitted by Australian Consumer Law, The Different Society is not liable for any indirect, incidental, or consequential loss arising from your use of the site or purchase of our products.
Nothing in these terms limits your rights under Australian Consumer Law, including your rights to a remedy for faulty goods.
11. Governing Law
These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
12. Changes to These Terms
We may update these terms from time to time. The current version will always be available on this page. Continued use of the site after changes are posted means you accept the updated terms.
